Ann: Justice Ginsburg, Anita* said you have something you want to say here.
Justice Ginsburg: Yes, Ann, I do. In spite of not being very far into my transition, because of the turmoil and confusion on the planet, I would like to take this opportunity to offer my two cents worth, particularly now that I have a broader view of things.
Ann: I think you always managed to take that view.
Justice Ginsburg: I tried, Ann, because that’s the only viewpoint worth having. When you are in the middle of a mess, nothing makes sense.
That is the beauty of the law and our legal system. The law makes it possible to tease out the structure of the problem at hand and follow each line of reasoning to its logical conclusion. As we do this as a practice, almost as a religion, we well find truths emerging in rapid and consistent fashion.
The truth we must recognize now is that the logic behind our system of government is failing. As we look to the handling of various matters of state, we find flaws and holes in the system that break the chain of logic and prevent reasoned decision making.
Thankfully, however, the basic structure of our system is still there and waiting to be tended to in order to flow more smoothly in the future.
We must not rush in all in alt or in a rage advocating for some particular cause or another. We must go quietly, resolutely, presenting the chain of logic for each point of view and allow the silliness of some of them to be revealed for all to see. Then we will be able to rework out system to function more accurately and efficiently.
Yes, I am concerned for my replacement, but she is only one person and may evolve as many have when they come to the Court and see those channels of reasoning presented in chambers where cleared eyed legal minds can argue their cases. There is room for different points of view. Not only room but conflicting views are a basic requirement for the implementation of justice because without discussion, argument, even impassioned advocacy, the full scope of an issue cannot be revealed.
I do recognize that even in that august body some who have come to the Court are so wedded to their causes that their minds are too rigid to allow logical reasoning to prevail, but such is not prevalent among the current justices. It is my hope that my replacement can carry her personal beliefs in a bag she can set under the table as she considers the legal precedent and present impact of the decisions before her.
Whatever happens, however, the court and our system of government will survive if we persevere in resolutely stating the obvious outcome of any line of reasoning, then do our best to implement those lines which are consistent with the equal administration of the law in in our country regardless of wealth, stature, race, sex, religion, or political persuasion.
I have great hopes that the unseemly underbelly of our government that has been revealed by this administration will act as a catalyst in, not just to get us back on course, but more importantly to restructure what has been broken so as to implement more effectively than ever before those great principles upon which this country was founded.
Ann: I have to ask, aren’t you exhausted? Don’t you need time to rest and regroup before jumping back into the fray again?
Justice Ginsburg: (Smiling) Well, I have a great deal of energy. It did take some time for me to learn to reconfigure it to facilitate this type of communication, but now that I have the hang of it, I will be available whenever needed or requested. Thank you for receiving me here.
